Enduring Power of Attorney

Realised that the deadline of 30th September 2007 is approaching. If you make an Enduring Power of Attorney before that date it remains valid even though the law is changing. From 1st October it will be more difficult and expensive to get the new Lasting Power of Attorney. You can download the current forms from the Public Guardianship Office. Download PDF, Print it, Read it VERY carefully if you don’t understand it take proper advice (not someone in the pub).

The new lasting power of attorney has been in place since October 2007, yet on a recent call around local solicitors I found 6 out of 10 were not yet in a position to issue them and the remaining 4 wanted between £600 and £1200 per document, with two being required per person, if both personal welfare and property and affairs were to be taken care of.

    Is this really progress?

    We use to include enduring powers of attorney free with all wills we wrote but now we have to make a small charge for them, still nothing like the figures being quoted by high street solicitors.

    I would appreciate peoples views on what they think about the new lasting power of attorney and do they believe that they are viable at the kind of prices being quoted by high street solicitors?
